HON'BLE SRI JUSTICE V.RAMASUBRAMANIAN AND HON'BLE SRI JUSTICE G.SHYAM PRASAD Writ Petition No.35465 of 2016 Order: (per V.Ramasubramanian, J.) Aggrieved by the refusal of the Andhra Pradesh Administrative Tribunal to interfere with the order of suspension, the petitioner is before us.

2. Heard Mr. Ch.Srinivas, learned counsel for the petitioner.

3. The petitioner was placed under suspension by an order dated 21-7-2016 on the ground that due to her negligence in the discharge of her duties as a Multi Purpose Health Supervisor in the Primary Health Centre, a mother and a baby died. The petitioner challenged the order of suspension before the Tribunal. The Tribunal rejected the challenge.

4. In a writ petition challenging an order of suspension, the scope of our jurisdiction is limited to seeking whether the allegations are grave enough to warrant suspension and whether suspension has been ordered by a competent authority. In this case both are satisfied. Therefore, the Tribunal was right in directing the petitioner to go before an appellate authority or to await the outcome of the disciplinary proceedings. We see no justification to interfere with the order of the Tribunal. Hence, the writ petition is dismissed. Since the order of suspension is already three

months old, the respondents should endeavour to initiate proceedings and complete the same within a period of four months so that the petitioner would know where she stands. The miscellaneous petitions, if any, pending in this writ petition shall stand closed. No costs.
