REDDY & THE HON'BLE SRI JUSTICE M.S.K.JAISWAL FCA MP No.179/2016 in FCA No.97/2009 & FCA No.97 of 2009 JUDGMENT: (per Hon'ble Sri Justice C.V.Nagarjuna Reddy) The unsuccessful petitioner in FCOP No.188 of 2009, on the file of the Judge, Family Court, Nellore, filed the above mention FCA against the order, dated 04.03.2009, dismissing the said FCOP filed for divorce against the respondent. Both the parties have filed FCA MP No.179 of 2016, wherein it is stated that during the pendency of this appeal, they have arrived at out of court a settlement by entering into a memorandum of compromise, dated 17.04.2016, containing various terms, subject to which, they pray for dissolution of their marriage.

At the hearing, the appellant and the respondent are personally present along with their minor daughter and they have informed the court that they have entered into the memorandum of compromise out of their free will and consent, as per which, they have agreed for dissolution of their marriage. In the light of the above facts, FCA MP No.179 of 2016 is allowed and compromise is recorded. Consequently, FCA No.97 of 2009 is allowed and FCOP.No.188 of 2009 is decreed, subject to the terms of memorandum of compromise, dated 17.04.2016, which shall form part of the decree.
