Writ petition is filed assailing the inaction on the part of the 4th respondent in considering the application dated 29-12-2015 made by the petitioner to conduct survey and to issue pattadar pass book and title deed in respect of the land in question.

2. Counter affidavit is filed by the 4th respondent stating that to conduct survey, the presence of other co-share holders is necessary and that on 10-07-2016, the Mandal Surveyor has informed the other co-share holders of the land, but they did not turn up for the survey and, therefore, the survey could not be conducted.

3. Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Revenue.

4. Though in the counter affidavit it is stated that the other co-share holders are informed, it is not stated whether notice was issued to them in writing. In the view of the same, without going into the merits of the case, the writ petition is disposed of directing the 4th respondent to consider the application of the petitioner and pass appropriate orders thereon within a period of four weeks from the date of receipt of a copy of this order, in

accordance with law, after issuing notices to other co-share holders and petitioner in writing, claiming interest if any in the land, as stated in the counter affidavit of the 4th respondent. Miscellaneous petitions, if any, pending in this Writ Petition shall also stand disposed of.
