HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.13625 of 2019 ORDER:

With the consent of both the parties, this writ petition is disposed of at the admission stage.

This writ petition is filed seeking the following relief :- "..... to issue Writ of Mandamus declaring inaction of the Respondents 2 to 4 in considering the request of the petitioner for regularization of his services on the basis of representation dated 08.06.2019 as illegal, arbitrary, discriminatory and violative of principles of natural justice and consequently direct the Respondents 2 to 4 to consider the case of the petitioner for regularisation taking a note of his father's date of regularization which was proposed and pass such other............."

Heard Sri Kowturu Pavan Kumar, learned counsel for the petitioner, learned Government Pleader for Services-II and Sri G.Narender Reddy, learned Standing counsel for 4th respondent.

It has been contended by the petitioner that he was appointed as Computer Operator on compassionate grounds with the 4th respondent Gram Panchayat after expiry of his father on 28.02.2012. The petitioner further contends that his father's name was incorporated for regularisation as per G.O.Ms.No.112 dt.23.07.1997 and G.O.Ms.No.212 dt.22.04.1994. The grievance of the petitioner is that though his case was considered for appointment on compassionate grounds, his services were not regularised. Therefore, petitioner had submitted a representation to the respondents

on 08.06.2019 requesting to consider his case for regularisation of his services as Computer Operator, but so far the respondents have not passed any orders on the said representation.

Learned counsel for the petitioner contends that the respondents have not passed any orders either rejecting or considering the case of the petitioner for regularisation of his services. Therefore, he contends that appropriate orders be passed directing the respondents to consider the representation submitted by the petitioner on 08.06.2019 and pass appropriate orders in accordance with law. Learned Government Pleader as well as learned Standing counsel appearing for the respondents contend that the case of the petitioner would be considered and appropriate orders would be passed on the representation submitted by the petitioner.

This Court, having considered the rival submissions, is of the considered view that this writ petition can be disposed of directing the respondents 2 to 4 to consider the representation submitted by the petitioner on 08.06.2019 and pass appropriate orders in accordance with law, within a period of eight weeks from the date of receipt of copy of this order.

With the above observations, the writ petition is disposed of. No order as to costs.

Pending miscellaneous petitions, if any, shall stand closed.
