THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.13558 of 2019 ORDER:

This Writ Petition is being disposed of at the admission stage with the consent of both the parties.

This Writ Petition is filed for the following relief: ".........Writ of Mandamus declaring the action of 4th respondent in not allowing the petitioners to attend duties w.e.f. 01.04.2019 without issuing any notice and without initiating any proceedings as illegal, arbitrary, discriminatory and violative of principles of natural justice and consequently direct the respondents 2 to 4 to allow the petitioners to continue in service as it is in view of their representation dated 09.04.2019 and pass such other........."

Heard Sri Kowturu Pavan Kumar, learned counsel for the petitioner, learned Government Pleader for Services-II and Sri G.Narender Reddy, learned counsel for the 4th respondent. It has been contended by the petitioners that they are working as Gumastha, Sanitation Worker and Electrician respectively through outsourcing in the Gram Panchayat since 2013 and they have been discharging their duties to the satisfaction of their superiors and everyone concerned. Petitioners further contend that the respondents without any notice and without initiating any proceedings are not allowing them to discharge their duties from 01.04.2019. Therefore, the petitioners submitted a representation to the respondents on 09.04.2019 requesting the respondents to continue them in service on the same terms and conditions. But so far the

respondents have not passed any orders on the said representation nor allowing them to continue in service. Learned counsel for the petitioners contends that appropriate orders be passed in the writ petition directing the respondents to consider the representation submitted by the petitioners on 09.04.2019 and pass appropriate orders in accordance with law.

Learned Standing counsel appearing for the 4th respondent contends that the case of the petitioners would be considered and appropriate orders would be passed on the representation submitted by the petitioners on 09.04.2019. This Court, having regard to the rival submissions made by the parties, is of the considered view that the writ petition can be disposed of directing the 3rd respondent to consider the representation submitted by the petitioners on 09.04.2019 and pass appropriate orders in accordance with law within a period of four weeks from the date of receipt of copy of this order. With the above observations, the writ petition is disposed of. No costs.

As a sequel, the miscellaneous petitions pending, if any, shall stand closed.
