Heard Sri M.V. Venu, learned counsel for the petitioners, learned Government Pleader for Finance and Planning (Telangana) for respondent Nos.1 and 2 and Sri Maheswara Rao Kuncheam, learned counsel for respondent Nos.3 and 4.

The grievance of the petitioners in this writ petition is non-disposal of the appeal said to have been filed by the petitioner herein on 07.11.2015 before the first respondent - State Government under Section 70 of the Chit Funds Act, 1982 (for short, the Act) against the award dated 11.09.2015 passed by the Deputy Registrar of Chits/Arbitrator, Kukatpally, Ranga Reddy District in Dispute No.430/2014.

The sum and substance of the case of the petitioners is that since the statutory appeal filed by them under Section 70 of the Act is pending consideration before the first respondent, the third respondent is not justified in proceeding with the execution. 4.

This Court, on 03.04.2017, granted interim stay for a period of four weeks. Today, when the matter is taken up, it is submitted by the learned counsel for respondent Nos.3 and 4 that there is absolutely no illegality in the impugned action and it is always open for the petitioners to pursue the appeal said to have been filed by them.

Having heard the learned counsel for the petitioners and the learned counsel for respondent Nos.3 and 4, this Court deems it appropriate to dispose of the present writ petition with a direction to the first respondent - State Government to pass appropriate orders

on the appeal dated 07.11.2015 said to have been filed by the petitioners against award dated 11.09.2015 passed in Dispute No.430/2014 by the Deputy Registrar of Chits/Arbitrator, Kukatpally, Ranga Reddy District, within a period of two months from the date of receipt of a copy of this order, after giving due opportunity of hearing to all the stake holders. Till the appeal is disposed of by the first respondent, the interim order granted by this Court on 03.04.2017 shall continue to operate.

Accordingly, the writ petition is disposed of. Miscellaneous petitions pending, if any, shall stand closed. No order as to costs. ____________________ A.V. SESHA SAI, J Date: 22.08.2017 TJMR
