The Hon'ble Sri Justice J.Sreenivas Rao Criminal Petition No.5765 of 2025 Order:

This Criminal Petition is filed by the petitioner/accused, seeking anticipatory bail under Section 482 of Bharatiya Nagrik Suraksha Sanhita (BNSS), in connection with Crime No.182 of 2025 of Mahabubnagar Rural Police Station, Mahabubnagar District, registered for the offences punishable under Sections 329 (3), 324(4), 351(2) and 318(4) read with 3(5) of BNS. 2.

Heard Mr. Naraparaju Avaneesh, learned counsel for the petitioner/accused and Mr. Syed Yasar Mamoon, learned Additional Public Prosecutor appearing for respondent/State.

The case of the prosecution is that the de-facto complainant filed a complaint on 02.07.2024, wherein it is stated that her mother is having three daughters and she is having land admeasuring Acs.3.17 guntas on her name and

Acs.2.10 guntas on her daughters name in Sy.Nos.234 and 235 of Appannapally Village. One Ravinder Reddy, who purchased the land from their co-share persons in the same survey number, demanded her mother to sell her land, but she refused to sell the same. The said Ravinder Reddy by saying gullible words to her mother, took loan by keeping their old pass book and kept her mother as guarantor and did not return their old pass book. Thereafter, they took new pass book from the revenue records. Again the said Ravinder Reddy threatened them with dire consequences and criminally trespassed into their land and fixed stones and digged pits with JCB. When they asked, he threatened them and 2 months back sold the land to Siri Venture. When the complainant was fixing boundary stones in their land, some unknown persons came there and threatened them and send voice message. Basing on the same, the present crime has been registered. 4.

Learned counsel for the petitioner/accused submits that the petitioner has not committed any offence and he was

falsely implicated in the aforesaid crime. He further submitted that even according to the allegations leveled in the complaint, the allegations are purely 'civil in nature' and the ingredients under alleged offences are against the petitioner. The petitioner is aged about 62 years old and suffering with age aliments and is not having any criminal antecedents. The petitioner is ready and willing to cooperate with the investigating officer and also abide by the conditions that may be imposed by the Court. 5.

Per contra, learned Additional Public Prosecutor submits that the investigation is under progress and if the petitioner/accused is granted anticipatory bail at this stage, there is every chance of his influencing the witnesses and interfering with the investigation.

Having considered the rival submissions made by the learned counsel for the parties and on perusal of the record, it reveals that there are property disputes pending between the petitioner and the de facto complainant in respect land covered

by Sy.Nos.234 and situated at Yedira Village, Mahabubanagar Mandal and District. Even according to learned Additional Public Prosecutor, the petitioner is not having any criminal antecedents. Taking into consideration of the facts and circumstances, this Court is inclined to grant anticipatory bail to the petitioner/accused subject to the following conditions:

(i) Petitioner/accused is directed to surrender before Station House Officer, Mahabubnagar Rural Police Station, on or before 07.05.2025;

(ii) On such surrender, the Station House Officer of Mahabubnagar Rural Police Station, shall release the petitioner on bail on his executing a personal bond for a sum of Rs.50,000/- (Rupees fifty thousand only) with two sureties for a likesum each to the satisfaction of the said Officer;

(iii) On such release, petitioner/accused shall appear before the Station House Officer, Mahabubnagar Rural Police station, on every

Monday at 11:00 a.m., for a period of eight weeks for the purpose of investigation and thereafter, as and when required for investigation.

(iv) Petitioner/accused shall abide by the conditions stipulated under Section 438(2) of Criminal Procedure Code, 1973/ Section 482 of BNSS and shall cooperate with the investigation officer for conclusion of investigation.

Subject to the above directions, the Criminal Petition is allowed. No costs.

As a sequel, miscellaneous petitions, pending if any, stand closed.
