THE HON'BLE SRI JUSTICE U.DURGA PRASAD RAO SECOND APPEAL No.762 of 2016 JUDGMENT:

When the Second Appeal has come up for admission, learned counsel for the appellant would fairly submit that no substantial questions of law are involved in this Second Appeal so as to seek for admission. However, he would submit that since the decree under appeal is an eviction decree wherein the appellate Court while confirming the trial Court judgment, did not grant any specific time for eviction, a reasonable time may be granted to the appellant for eviction of the plaint schedule property. 2.

Learned counsel for the respondent is present and did not object for the same.

In that view of the matter, while dismissing the Second Appeal at the admission stage as there are no substantial questions of law involved, the appellant/defendant is granted four

(04) months time from the date of this Judgment to evict the suit schedule property, failing which the respondent/plaintiff will be at liberty to execute the decree. No further extension of time will be granted.
