THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.5795 OF 2015 ORDER:

This criminal petition under Section 438 of the Code of Criminal Procedure is filed by the petitioners/A.1 to A.5 seeking grant of anticipatory bail in connection with crime No.74 of 2015 on the file of the P.S., Yemmiganur, registered for the offences under Sections 498-A read with Section 34 IPC and Sections 3 and 4 of the Dowry Prohibition Act. Heard and perused the records.

On perusing the complaint, this Court is of the view that except the omnibus allegations, no specific overt acts are alleged against the petitioners. The case is arising out of matrimonial disputes, and as such, if the petitioners are arrested, it would cause prejudice for the parties for amicable settlement in future.

Having regard to the facts and circumstances of the case and the nature of allegations against the petitioners, this Court is inclined to grant anticipatory bail to the petitioners herein.

In the circumstances, the petitioners/A.1 to A.5 are directed to surrender before the Magistrate concerned within a period of fifteen days from today and on such surrender, they shall be enlarged on bail on the same day on each of them executing a personal bond for a sum of Rs.10,000/- (Rupees ten thousand only) each with one surety each for a like sum each to the satisfaction of the said Magistrate. Further, the petitioners/A.1 to A.5 are directed to report before the Station House Officer as and when required.
