This Writ Petition is being disposed of at the admission stage with the consent of both the parties.
This Writ Petition is filed for the following relief: ".........Writ of Mandamus declaring the impugned action of the 1st respondent in depriving my claim for promotion on the pretext the petitioner was appointed as Village Revenue Assistant in ban period (infact no mention as my appointment dt.0112-2006) though he is eligible and entitled for promotion to the post of Village Revenue Officer based on the report furnished by the Revenue Divisional Officer, Peddapally vide dt.26-12-2011 and report of the Tahasildar, Sultanabad dt.16-122011 is illegal, unwarranted and improper and consequently declare that the petitioner is entitled and eligible to be promoted as Village Revenue Officer by deleting the remark "appointed in Ban" with all consequential benefits........"
Heard Sri K.Srinevas Prasad, learned counsel for the petitioner and learned Government Pleader for Services-II. It has been contended by the petitioner that he was initially appointed as Village Revenue Assistant during 2006 and has been discharging his duties to the satisfaction of his superiors and everyone concerned. Petitioner further contends that though he is fully eligible and qualified for promotion to the post of Village Revenue Officer, the respondents are not considering his case for promotion on the ground that he is appointed in Ban period.
Learned counsel for the petitioner contends that petitioner has submitted a representation to the respondents on 10.06.2019 requesting them to consider his case for promotion to the post of Village Revenue Officer. But so far the respondents have not considered the case of the petitioner.
Therefore, learned counsel contends that appropriate orders be passed in the writ petition directing the respondents to consider the case of the petitioner for promotion to the post of Village Revenue Officer without reference to the report furnished by the Revenue Divisional Officer, Peddapally dt.26.12.2011 and report of the Tahsildar, Sultanabad dt.16.12.2011 .
Learned Government Pleader for respondents submits that the representation submitted by the petitioner on 10.06.2019 would be considered and appropriate orders would be passed in accordance with law.
This Court, having regard to the rival submissions made by the parties, is of the considered view that this writ petition can be disposed of directing the respondents to consider the representation submitted by the petitioner on 10.06.2019 requesting to consider his case for promotion to the post of Village Revenue Officer and pass appropriate orders in accordance with law, within a period of eight weeks from the date of receipt of copy of this order.
With the above observations, the writ petition is disposed of. No costs.
As a sequel, the miscellaneous petitions pending, if any, shall stand closed.
