HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN AND HON'BLE Dr. JUSTICE SHAMEEM AKTHER WRIT APPEAL Nos.337, 338 & 340 OF 2017 COMMON JUDGMENT: (Per Hon'ble The Acting Chief Justice Ramesh Ranganathan) Heard Sri P. Radha Krishna, learned counsel for the appellant-writ petitioner, and Sri A. Panduranga Rao, learned standing counsel for the 2nd respondent-Kakinada Municipal Corporation in all these Appeals, and, with their consent, the Appeals are disposed of at the stage of admission. After arguing for some time, Sri P. Radha Krishna, learned counsel for the appellant-writ petitioner, submits that, instead of adjudicating the appellant-petitioner's contention on merits, it would suffice if this Court were to consider the appellant-writ petitioner's request for grant of some more time to comply with the interim orders passed by the learned Single Judge.

The learned Single Judge has, in the orders under Appeal, granted interim suspension on condition that the petitioner paid 1/4th of the demanded tax amount in two equal instalments; the first to be paid on or before 01.04.2017 and the 2nd instalment to be paid on or before 15.05.2017. As the appellant-writ petitioner only seeks time for payment of the said amount, having given up all the contentions urged in these Appeals, with liberty to raise them during the final hearing of the Writ Petitions, we consider it appropriate to extend the time stipulated by the learned Single Judge, to pay 1/4th of the demanded tax amount, by a further period. Consequently, the appellant-petitioner shall pay the 1st instalment by 30.04.2017 and the 2nd instalment by 30.06.2017.

HACJ & Dr.SA,J WA Nos.337, 338 & 340/2017 The Writ Appeals, stand disposed of accordingly. As a sequel, pending miscellaneous petitions, if any, shall stand disposed of. No order as to costs.
