THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO. 3500 of 2022 O R D E R:

This Criminal Petition is filed under Sections 438 of the Code of Criminal Procedure, 1973 (for short "Cr.P.C.") seeking pre arrest bail in the event of his arrest, in connection with Crime No.26 of 2022 of Bollaram P.S registered for the offence punishable under Sections 20 (b) (ii) (C) , 27 read with Section 8 (c) of NDPS Act, 1985 2.

Heard the learned counsel for the petitioner and learned Assistant Public Prosecutor for the respondent-State and perused the record.

The learned Counsel for the petitioner submits that according to the prosecution the petitioner is a drug consumer and protection is also prescribed under NDPS Act. However, keeping in view that the allegation against this petitioner is only of drug consumer, the petitioner can be granted anticipatory bail.

In the said circumstances, the petitioner-accused is directed to surrender before the concerned police, within ten

days from the date of this order, and upon such surrender he shall be enlarged on bail on his executing personal bond for Rs.20,000/- (Rupees Twenty Thousand only), with two sureties to the satisfaction of the concerned police. The petitioner shall appear before the police concerned, on every Saturday, for a period of two months and shall cooperate in the investigation.

Accordingly, the Criminal Petition is allowed. As a sequel thereto, miscellaneous applications, if any pending, shall stand closed.
