Petitioner's husband, while working as Coal Cutter in the respondent - Company, met with an accident in the year 1995 and suffered grievous injury to his spine resulting in physical disablement. The Medical Board declared the husband of the petitioner unfit to work as Coal Cutter in underground. Therefore, by proceedings, dated 27.11.1995, his services were terminated. According to the petitioner, her husband earlier married her elder sister and later he married her. She further alleges that her sister died in the year 1992. According to the petitioner, as per the scheme formulated by the respondent - Company in the year 1997, provision is made for payment of monthly monitory compensation to the female dependant in case of death/permanent total disablement.

The said scheme also envisages employment of dependant concerned, who attains 18 years of age and payment of monthly monitory compensation till the time the dependant is employed in the respondent - Company. The grievance of the petitioner is that in terms of the said scheme, she is entitled to monthly monitory compensation of Rs.3,000/- from December, 1995 onwards and as revised from time to time, but the same is not being paid to her. Ventilating her grievance, the petitioner submitted representations, dated 13.12.2016 and 10.02.2017. Alleging inaction on the said representations, the petitioner filed the present Writ Petition.

When the matter is taken up for consideration, learned counsel for the petitioner fairly submits that since representations are already submitted, the petitioner would be satisfied if a direction is issued to pass orders on the said representations within a fixed time frame.

Having regard to the said submission and without expressing any opinion on the merits of the case, the Writ Petition is disposed of directing the Director (Personal Administration and Welfare), Singareni Collieries Company Limited, Kothagudem, the 2nd respondent, to examine the claim of the petitioner as ventilated in her representation, dated 10.02.2017, and pass appropriate orders as warranted by law by assigning due reasons in support of his decision, within a period of eight weeks from the date of receipt of a copy of this order and communicate the same to the petitioner. There shall be no order as to costs. Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
