THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.5820 OF 2016 ORDER:
Learned counsel appearing for the parties are at consensus that the order dated 16.11.2007 passed by this Court in W.P.No.12861 of 2007 would govern the present case.
In that view of the matter, for reasons alike as were stated in the afore-stated order and in terms thereof, the writ petition is disposed of directing the respondents to reconsider the application of the petitioner for granting building permission. However, in the event LGC No.29 of 2006, which is pending before the Special Court, is decided against it, the petitioner company shall not claim any equities or compensation for the cost of the building constructed by it. Pending miscellaneous petitions, if any, shall stand closed in the light of this final order. No order as to costs. ____________________ JUSTICE SANJAY KUMAR 24th February, 2016 IBL
