THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI Writ Petition No.15908 of 2007 ORDER:

This writ petition under Article 226 of the Constitution of India is filed seeking the following relief/s:

'to issue an order of direction or writ more particularly one in the nature of writ of mandamus declaring the proceedings in RCA No.408/2006, Dt.13-7-2007 issued by the Tahsildar, Kaligiri, Nellore District, as bad, illegal, arbitrary and contrary and violative of Principles of natural justice and offends under Articles 14, 19 and 21 of Constitution of India by setting aside the same and consequently direct the Respondents No.1 to 3 to continue the petition as a Cook to implement the Mid Day Meals Scheme at MPP School, Siddanakonduru Village, Kaligiri Mandal, Nellore District, and to pass such other order....'

[Reproduced verbatim] I have heard the submissions of the learned counsel for the writ petitioner and the learned Assistant Government Pleader for Education appearing for the 3rd respondent.

On the previous date of hearing, the learned AGP sought time to secure instructions as to whether the writ petitioner was being continued as a Cook for implementation of the Mid Day Meals scheme at MPP School, Siddanakonduru village of Kaligiri Mandal.

At the hearing today, the learned AGP would submit that he had received instructions to the effect that the writ petition is filed suspecting that the writ petitioner may be removed from her job and that as on today, she is continuing in service as a Cook in the same school under Mid Day Meals scheme and that in case, the 3rd respondent intends to discontinue her services, the procedure established by law would be followed. However, the learned counsel for the writ petitioner would submit that though the writ petitioner is being continued in service as a Cook under

the Mid Day Meals scheme, she now intends to voluntarily retire from service in view of her advanced age. He, therefore, prays that the writ petition may be closed as no further orders are required.

Recording the aforesaid submissions, the Writ Petition is disposed of accordingly. There shall be no order as to costs. Miscellaneous petitions pending, if any, in this writ petition shall stand closed.
