THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI WRIT PETITION No.11415 OF 2018 ORDER:

In this Writ Petition, under Article 226 of the Constitution of India, the complaint of the petitioner is that respondent Nos.2 to 5, at the behest of respondent Nos.6 and 7, are illegally interfering with the constructions being made by the petitioner, in accordance with the building permit sanctioned, in plot No.8 in Survey Nos.319 to 322 admeasuring 211 Square Yards situated at Rajeev Nagar, Venkatapuram, Alwal Village, GHMC Alwal Circle, Malkajgiri Mandal, Ranga Reddy District.

I have heard the submissions of Sri Peri Prabhakar, learned counsel appearing for the petitioner, and of the learned Government Pleader for Home (TG) appearing for respondent Nos.1 to 5. I have perused the material record. 3.

At the hearing, learned counsel for the petitioner would submit that if a direction is given to respondent Nos.2 to 5 not to interfere with the constructions being made by the petitioner, the ends of justice would be met.

The learned Government Pleader for Home, on written instructions, a copy of which is placed on record, would submit that a case in Crime No.13 of 2018 was registered against the petitioner and others on 09.01.2018 for the offences punishable under Sections 447 and 427 I.P.C. by the Station House Officer, Alwal Police Station, and investigation is taken up.

However, it is not in dispute that a copy of the said F.I.R. is already filed by the petitioner along with the material papers. 6.

Having regard to the facts and submissions, the Writ Petition is disposed of directing respondent Nos.2 to 5 not to interfere with the constructions being made by the petitioner in the subject property, as per the building permit sanctioned. It is made clear that this order will not preclude the police officer concerned from investigating into the afore-stated crime by following the procedure established by law.

Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.

There shall be no order as to costs.
