IN THE HIGH COURT OF JUDICATURE AT HYDERABAD

FOR THE STATE OF TELANGANA AND THE STATE OF ANDHRA PRADESH **** WRIT PETITION NO.33986 OF 2015 DATED 24th NOVEMBER, 2015 Between:

Kanna Satheesh .. Petitioner and The State of Telangana rep. by its Principal Secretary, Home (Prison) Department and another .. Respondents

THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION NO.33986 OF 2015

O R D E R

The grievance of the petitioner/party-in-person was that the respondent authorities were not considering his application for extension of his parole by a further period of four months.

Learned Assistant Government Pleader for Home placed on record a copy of the Memo bearing No.576(P)/Legal/A1/2015 dated 13.08.2015 passed by the Principal Secretary to Government, Home (Services-III) Department, Government of Telangana, rejecting the request of the petitioner/party-in-person for extension of his parole. The Superintendent of Jails, Central Prison, Cherlapalli, was requested thereunder to inform the same to the individual. However, learned Assistant Government Pleader for Home is unable to demonstrate before this Court that the Memo dated 13.08.2015 was served upon the petitioner/party-in-person earlier.

In that view of the matter, as a copy of the said Memo was only given to the petitioner/party-in-person in open Court, the same shall not be given effect to for a period of one week from today. It shall be open to the petitioner to take recourse to appropriate legal remedies in accordance with law in the event he is aggrieved by the said Memo. In the light of the aforestated developments, the cause in this writ petition no longer survives. The writ petition is accordingly closed subject to the liberty aforestated. Pending miscellaneous petitions shall stand closed in the light of this final order. No order as to costs.
