...RESPONDENT/RESPONDENT Petition under Section 148 RAIV 29A(5) of the Arbitration and Conciliation Act 1996, praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to extend the time for the completion of Arbitration proceedings by the arbitrator M. Chalapathi Rao District Judge (Retd) in Arb Appl.No. 20 ol 2010.
This Petition coming on for hearing, upon perusing the Petition and the petition and the affidavit filed in support thereof and the order of the High Court order dated 04-02-2020, made herein and upon hearing the arguments of Sri K. PRADEEP REDDY, Advocate for the Petitioner and Ms. Sonal Rathi, representing Ivlr. B. Nalin Kumar, Advocate for the respondent. The Court made the following: ORDER
Heard Mr. K. Pradeep Kumar, learned counsel for the Petitioners and Ms. Sonal Rathi, learned counsel representing Mr. Nalin Kumar, Iearned Cbunsel for the respondent.
This application has been filed seeking extension of time for completion of arbitration proceedings.
It may be mentioned that earlier Sri S-Rama Krishna Reddy was appointed as Arbitrator. However on his death, Sri M. Chalapathi was appointed as the Arbitrator. It is submitted that arbitration proceedings before the sole arbitrator is continuing but got disrupted in the interregnum because of COVID- 19. On a query by the Court, learned counsel for the parties have informed that the proceedings are at the stage of adducing of evidence. Another three to four months would be required for completion of proceedings. That being the position, time for completion of arbitration proceedings is extended by a period of four (04) months.
