HON'BLE SRI JUSTICE S. RAVI KUMAR TRANSFER C.M.P.No.800 of 2014 ORDER :

This petition is filed to transfer O.P.No.1569 of 2013 from the file of Family Court, Ranga Reddy to Family Court, Guntur.

2. Petitioner-wife filed her affidavit and according her affidavit respondent is threatening her with dire consequences and forcing her to give divorce whenever she attended the Court at Ranga Reddy and that there was a threat to her at Ranga Reddy. She further stated that she has a small kid aged about five months and it is difficult for her to travel from Chennai to Ranga Reddy or Tadikonda to Ranga Reddy for the purpose of defending O.P. and by taking her convenience into consideration, she prayed for transfer of O.P. from Family Court, Ranga Reddy to Family Court, Guntur.

3. Respondent opposed the petition and disputed the allegation of threat and forcing her to withdraw the O.P. and contended that it is only created for the purpose of transfer C.M.P.

4. Heard both sides.

5. I have perused the material papers filed along with transfer C.M.P. and also counter affidavit filed on behalf of respondent-husband. From the submissions, it is clear that petitioner is now staying at Tadikonda and that she is

employed at Chennai, but at present she is on leave because of the tender age of the girl. Considering the age of the baby and the distance from Tadikonda to Ranga Reddy which is about 300 kms., I feel that the request of petitioner be considered for transfer by directing the trial court to dispose of O.P. within a stipulated time by dispensing with the presence of respondent-husband for each and every adjournment.

6. Accordingly, O.P.No.1569 of 2013 is withdrawn from Family Court, Ranga Reddy, and transferred to Family Court, Guntur, for disposal in accordance with law. The Family Court, Guntur, shall decide the O.P. within six months from the date of receipt of records by dispensing with the presence of respondent herein for each and every adjournment. However, he shall appear as and when his physical presence is necessary for any specific purpose.

7. Accordingly, transfer C.M.P. is allowed. No costs.
