O R D E R

The complaint of the petitioner in this case was that the Inspector of Police, Special Investigation Team, Shanti Nagar, Masabtank, Hyderabad, was calling him

and detaining him in the police station without there being any case registered against him. He therefore sought a direction to the police not to do so. Basing upon the written instructions dated 04.08.2011 received from the Inspector of Police, Special Investigation Team, Hyderabad, the learned Assistant Government Pleader informed this Court that six criminal cases were registered on the file of the Chaderghat Police Station, Hyderabad. Subsequently, the Special Investigation Team conducted investigation in these crimes and charge sheets were also filed before the competent criminal Court. The petitioner is stated to be accused No.5 in all the said cases, though his name was shown therein as Syed Mateen S/o Syed Arif Pasha, and not Syed Masood Pasha S/o Syed Arif Pasha, as described in the cause title in this case.

Non-bailable warrants are stated to have been issued against him by the learned XIV Additional Chief Metropolitan Magistrate, Nampally, Hyderabad. The petitioner allegedly filed the present writ petition in order to evade the execution of the non-bailable warrants issued against him, by claiming that he is not Syed Mateen.

In the light of the above written instructions, this Court finds no reason to interfere in the matter. Needless to state, in the event the police authorities execute the non-bailable warrants, they would have to do so strictly in accordance with the due procedure and it would be for them to establish the identity of the accused in the crimes.

The writ petition is accordingly closed. Pending miscellaneous petitions shall also stand closed. No order as to costs.
