PNR, J W.P.No.10404 of 2017 HON'BLE SRI JUSTICE P. NAVEEN RAO WRIT PETITION No.10404 of 2017 ORDER :
The petitioner is removed from service, by order, dated 09.02.2017. Aggrieved thereby, the petitioner claims to have submitted an appeal on 03.03.2017 before the District Collector, Nagarkurnool-4th respondent. Without waiting for the decision of the appellate Authority, this writ petition is filed. As the petitioner has already availed the remedy of appeal, this Court is not inclined to entertain the writ petition and keep the same pending. Since the appeal was preferred on 03.03.2017, it cannot be said that there was delay on the part of the 4th respondent in passing the orders on the appeal preferred by the petitioner. Accordingly, the Writ Petition is dismissed, leaving it open to the petitioner to prosecute his appeal pending before the 4th respondent. It is needless to observe that the 4th respondent shall consider the appeal and pass appropriate orders, as expeditiously as possible, preferably within a period of two months from the date of receipt of a copy of this order and communicate the decision to the petitioner.
As a sequel, miscellaneous petitions pending, if any, shall stand dismissed. There shall be no order as to costs. __________________ P. NAVEEN RAO, J 24th March 2017.
