THE HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN C.R.P.Nos.3051 and 3052 of 2016 COMMON ORDER:

Heard Sri G. Satish, learned counsel for the petitioner, and Sri T. Surya Satish, learned counsel for respondent No.1, and, with their consent, these Civil Revision Petitions are being disposed of at the stage of admission.

While Sri G.Satish, learned counsel for the petitioner, would assert that a false submission was made, by the learned counsel for the respondents before this Court on 29.07.2016, that permission had been obtained from the GHMC for construction of a G+2 building, and the permission granted was only for construction of a G+1 building, Sri T.Surya Satish, learned counsel for respondent No.1, would submit that all these matters can be examined by the Court below.

A report is submitted by the learned XVII Additional Senior Civil Judge, City Civil Court, Hyderabad regarding the stage of construction which shows that the subject building, consisting of five floors, is in a semi-constructed state. A copy of this report shall be forwarded and placed before the learned I Additional Chief Judge, City Civil Court, Secunderabad in O.S.No.53 of 2016. It is open to the parties to request the learned I Additional Chief Judge, City Civil Court, Secunderabad to make available copies of the report to them.

Both Sri G. Satish, learned counsel for the petitioner, and Sri T. Surya Satish, learned counsel for respondent No.1, would agree that it would suffice if, instead of adjudicating the Civil Revision Petitions on merits, the learned I Additional Chief Judge,

City Civil Court, Secunderabad, is directed to decide the interlocutory applications in the aforesaid suit within six weeks, and the interim order granted by this Court earlier is extended by a further period of eight weeks.

In view of the submission of the learned counsel on either side, I consider it appropriate to dispose of the Civil Revision Petitions requesting the learned I Additional Chief Judge, City Civil Court, Secunderabad to decide the I.As with utmost expedition and, in any event, within a period of six weeks from today. The interim order granted earlier shall continue to remain in force for a period of eight weeks from today.

The Civil Revision Petitions are disposed of accordingly. Miscellaneous petitions pending, if any, shall also stand disposed of. There shall be no order as to costs.
