HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.11243 OF 2018 ORDER:
Heard Sri Kilaru Nithin Krishna, learned counsel for the petitioner, and learned Government Pleader for Home, appearing for respondent Nos.1 to 6.
When the matter is taken up, instructions in the form of draft counter, signed by the 6th respondent, dated 20.08.2018, are placed on record by the learned Government Pleader. Paragraph 10 of the said instructions reads as under:
"10.
It is pertinent to submit that this respondent has carefully perused the representation of the petitioner which was submitted after long lapse of 4 years of filing of charge sheet before the concerned Hon'ble Court and accordingly considered his request for conducting further investigation into the case. The said fact of further investigation into the case on hand was also communicated to the petitioner/complainant herein. I assure to this Hon'ble Court further investigation basing on the representation of the petitioner herein is under progress. Basing on the outcome of the investigation if any further clues as made in the representation of the petitioner herein are forthcoming, certainly, this respondent will file supplementary charge sheet U/sec.173(8) Cr.P.C. before the concerned Hon'ble Court or intimate the result of further investigation to the petitioner/complainant. I humbly submit that the request of the petitioner for conducting further investigation into the case was considered by the respondent police. Hence, the writ petition deserves no consideration."
Having regard to the contents of the above instructions, this Court deems it appropriate to dispose of the Writ Petition by placing the aforesaid instructions on record.
Accordingly, the writ petition is disposed of. No costs.
Miscellaneous petitions, if any pending, shall also stand disposed of AVSS,J W.P. No.11243/2018 in consequence.
