Heard learned counsel for the petitioner and learned Government Pleader for Revenue appearing for respondents 1 to 4. 2.
Petitioner claims that the subject lands originally belongs to his mother, by name, Smt. Narasamma. He is aggrieved by the entry of the names of unofficial respondents in the revenue records and issuance of pattadar passbooks and title deeds in their favour. Petitioner preferred appeal before the Sub Collector, Madanapalle, Chittoor District, under Section 5(5) of the Andhra Pradesh Rights in Land and Pattadar Passbooks Act, 1971 (for short, 'the Act') for deleting the names of unofficial respondents and cancelling pattadar passbooks and title deeds and for including his name in the revenue records. Alleging inaction on the said appeal, this Writ Petition is filed.

Since petitioner claims that he has already preferred appeal and the same is pending consideration before the Sub-Collector and no decision is made on the said appeal, without expressing any opinion on the merits of the case, the Writ Petition is disposed of directing the Sub-Collector, Madanapalle, Chittoor District, the 2nd respondent, to examine the claim of the petitioner as ventilated in his appeal filed under Section 5(5) of the Act and pass appropriate orders as warranted by law by assigning due reasons in support of his decision and communicate the same to the petitioner within a period of eight (8) weeks from the date of receipt of a copy of this order. There shall be no order as to costs.
Miscellaneous Petitions, if any, filed in this Writ Petition shall stand closed.
