HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 13247 OF 2017 ORDER:

The Writ Petition is filed to declare the action of Respondents 2 and 3 in not releasing 4200 kgs. of white jaggery of the petitioner seized in connection with PR No. 59 of 2017 dated 15.02.2017 on the file of the 3rd respondent, as illegal and arbitrary.

Heard learned counsel for the petitioner as well as learned Government Pleader for Prohibition & Excise.

Subject to the condition of the petitioner furnishing a personal bond for Rs.1,60,000/- (Rupees one lac sixty thousand only), the interim custody of the white jaggery shall be given in favour of the petitioner, which, however, shall be subject to further orders that may be passed by the 2nd respondent Deputy Commissioner in the inquiry proceedings.

The Writ Petition is therefore, disposed of. No costs. Miscellaneous Petitions pending, if any, in this writ petition shall stand closed.
