HON'BLE SRI JUSTICE V.RAMASUBRAMANIAN Civil Revision Petition No.4152 of 2017 Order:

Aggrieved by the refusal of the Trial Court to grant an order of injunction, which was also confirmed by the First Appellate Court, the plaintiff in a suit for bare injunction has come up with the above revision.

2. Heard Mr. V.Ravinder Rao, learned Senior Counsel appearing for the petitioner.

3. The application for injunction was dismissed by the Trial Court on 18-4-2016. The appeal filed against the dismissal of the injunction application was dismissed on 27-3-2017. During the pendency of the miscellaneous appeal, the petitioner did not have any protective order.

4. Therefore, this is not a case for exercising the revisional jurisdiction under Article 227 of the Constitution of India. Hence, the civil revision petition is dismissed. However, in view of the peculiar facts and circumstances of the case, the Trial Court is directed to take up the suit for disposal and endeavour to dispose it of within a period of 3 (three) months. The miscellaneous petitions, if any, pending in this revision shall stand closed. No costs. __________________________ V.RAMASUBRAMANIAN, J.
