HONOURABLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No. 10389 of 2015 ORDER:

Heard learned Counsel for the petitioners and learned Government Pleader for the respondents.

The petitioners are the absolute owners and possessors of the land admeasuring Ac.1.08 Gts each in Sy.No.1092 of Ghanapur, H/o Edulabad Village, Ghatkesar Mandal, Ranga Reddy District. The said land is described as residential zone by the Hyderabad Metro Development Authority (HMDA). However, the respondents are trying to interfere with the lands of the petitioners without issuing prior notice. In these circumstances, the present Writ Petition is filed challenging the action of respondents 2 and 3 in erecting high-tension lines in the aforesaid lands of the petitioners.

A counter affidavit is filed on behalf of respondents 2 and 3 stating that no tower foundation is falling in the petitioners land, but only one side conductor of multi circuit line is passing over their lands. It is further stated that if the petitioners suffer any loss on account of laying the line over their lands, the petitioners are entitled to claim compensation. Now the learned Counsel for the petitioners submits that after filing the present Writ Petition, the petitioners made their representations to the District Collector, Ranga Reddy District on 17.06.2015 for payment of compensation.

In view of the same, the District Collector, Ranga Reddy District, who is not made as a party respondent to the present Writ Petition, is directed to consider the representation of the petitioners dated 17.06.2015 for payment of compensation in respect of high tension lines passing through their lands in question and dispose of the same within a period of ninety days from the date of receipt of a copy of this order. The Writ Petition is accordingly disposed of. Miscellaneous petitions pending consideration if any in the Writ Petition shall stand closed in consequence. No order as to costs.
