THE HONOURABLE SRI JUSTICE N. TUKARAMJI CRIMINAL PETITION No.5543 OF 2024 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/Accused No.1 in Crime.No.306 of 2024 on the file of Meerpet Police Station, Ranga Reddy District, registered for the offences under Sections 324 and 307 r/w. 34 of IPC.

I have heard Sri P.Prabhakar Reddy, learned counsel for the petitioner and learned Additional Public Prosecutor for the respondent-State and perused the record. 3.

This is the successive bail application. Earlier bail application was dismissed on 03.05.2024.

Learned counsel for the petitioner submits that the investigation agency has completed its investigation and the petitioner is in judicial custody for more than 60 days. Further, pleads that the Court in the earlier bail application failed to consider the manner of occurrence and the injuries

which were suffered by the accused are in sudden provocation and rage. Hence, there is no pre mediation and as the investigation is completed, prayed for enlarging the petitioner on bail.

Learned Additional Public Prosecutor would submit that as per the instructions, five witnesses were examined and medical reports are received. However, examination of the official witnesses is only pending.

Having regard to the nature of offence, duration of the judicial custody undergone by the petitioner, the present stage of investigation and also the other circumstances of the case, I am inclined to grant bail to the petitioner. 7.

Accordingly, the petitioner is directed to be released on bail on executing a self bond for a sum of Rs.25,000/- (Rupees Twenty Five thousand only) with two sureties, for a like sum each to the satisfaction of the VI Metropolitan Magistrate, at L.B.Nagar, Ranga Reddy District. Further, the petitioner/Accused No.1 is directed to make himself available for interrogation as and when required by the Police till filing

of the charge sheet. The petitioner/accused No.1 shall not interfere or intimidate the prosecution witnesses nor shall attempt to tamper with the evidence. The petitioner shall not commit any offence while on bail. If the petitioner/accused No.1 commits any breach of the above conditions, the investigating agency/prosecution shall be at liberty to initiate proceedings for cancellation of bail.

Additionally petitioner/Accused No.1 shall abide by the other conditions stipulated under Section 437(3) of Cr.P.C.

Accordingly, this Criminal Petition is allowed.

Miscellaneous applications, pending if any, shall stand closed.
