THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION NO.30440 OF 2010 ORDER:

This writ petition is filed seeking to issue writ of mandamus declaring the action of the 5th respondent in refusing to send the 'No Objection Certificate' (NOC) along with his report directly to the 2nd respondent about the classification and availability of land applied by the petitioner in his application, dated 16-06-2010 for grant of quarry lease in Sy.No.1202/15 of Badikayalapalle village of B.Kotha Kota Mandal, Chittoor District in total extent of Ac.2.000 Hectors as illegal, improper and contrary to G.O.Ms.No.181 (Ind. & Com (Mines-I) Department, dated 28-05-1998.

2. This Court, vide order, dated 07-12-2010 directed the 5th respondent to send his report to the application of the petitioner to the 2nd respondent directly in accordance with G.O.Ms.No.181, dated 2805-1998.

3. In view of the said interim direction, no further orders are necessary in the present writ petition.

4. Accordingly, the writ petition is dismissed as infructuous. No order as to costs. Miscellaneous petitions, if any pending in this writ petition shall stand closed.
