WRIT PETITION No.20128 of 2015 ORDER:

Petitioner claims to be the owner of the land to an extent of Ac.0.09 cents in Sy.No.80/11 of Amudalavalasa Revenue Village, Srikakulam District. Petitioner contends that on the land owned by him, the respondent-Municipality proposing to lay a road without following due process of law.

2. Learned standing counsel, on instructions, submits that Municipality is not taking possession of the land and not laying a road on private property and if the private property is required for laying a road due process shall be followed.

3. A bare look at the photographs enclosed to the writ petition, it appears that a road is already formed. If the petitioner establishes that the property belongs to him and the respondents are in need of private property for laying a road, it is needless to observe that procedure as contemplated by law shall be followed before undertaking of laying a road.

4. It is open to the petitioner to submit a representation to the Municipality showing evidence in support of his claim that particular piece of land belongs to him and as and when such representation is filed by the petitioner, the Municipality shall consider objectively and pass appropriate orders as warranted by law. With the above observations, this writ petition is disposed of.

Miscellaneous petitions if any pending in this writ petition shall stand closed. There shall be no order as to costs.
