HONOURABLE SRI JUSTICE U.DURGA PRASAD RAO CRIMINAL PETITION No.4016 OF 2018 ORDER:

This Criminal Petition is filed under Section 482 Cr.P.C by the petitioners/accused seeking to quash the proceedings against them in C.C. No.199 of 2016 on the file of Additional Judicial Magistrate of First Class, Sullurpeta, SPSR Nellore District, wherein cognizance was taken for the offences under Section 498-A of I.P.C. and Sections 3 and 4 of Dowry Prohibition Act.

Having regard to the fact that the matter is now posted before the trial court for framing charges, this Court considers it not apposite to pass any order. Therefore, liberty is given to the petitioners to seek for discharge by filing appropriate application before the trial court, in which case, the said Court shall pass appropriate orders on merits expeditiously.

Considering the request of the learned counsel for the petitioners, that petitioners/A.1 and A.2 are aged persons and petitioners/A.3 and A.4 are married women and they are residents of Vijayawada in Krishna District, their appearance before the trial court is dispensed with except on the occasions when the trial court requires their attendance.

Accordingly, this Criminal Petition is disposed of. As a sequel, miscellaneous applications pending if any, shall stand closed.
