The 1st petitioner was appointed as Trained Graduate Teacher and the 2nd petitioner was appointed as Post Graduate Teacher. Petitioners claim to have been appointed in the year 1996. Their services were regularised and on attaining the age of superannuation, they retired from service. Their grievance is regarding non-computation of service rendered prior to granting of regularisation for the purpose of determination of retirement benefits. In support of their contention that service prior to regularisation should also be computed for the purpose of determination of retirement benefits, they placed reliance on the Office Memorandum, dated 26.08.2016.

Whether the Office Memorandum of the Government of India would apply to the case of the petitioners and whether the petitioners are entitled to seek computation of service rendered from the date of joining the service are matters that require consideration by the competent authority. It appears, the 1st petitioner submitted representations on 04.01.2016 and on 28.03.2016, but so far no orders are passed. The 2nd petitioner has not submitted any representation.

Having regard to these facts, the Writ Petition is disposed of granting liberty to the 2nd petitioner to submit representation ventilating her grievance to be addressed to the Secretary of the 2nd respondent - Society and as and when such representation is received, the 2nd respondent shall consider the same along with the
representation submitted by the 1st petitioner on 04.01.2016 followed by another representation, dated 28.03.2016, examine their grievance and pass appropriate orders as expeditiously as possible preferably within a period of two months from the date of receipt of representation by the 2nd petitioner and communicate the decision to the petitioners by a reasoned order. There shall be no order as to costs.
Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
