HON'BLE THE CHIEF JUSTICE SRI THOTTATHIL B. RADHAKRISHNAN AND HON'BLE SRI JUSTICE V. RAMASUBRAMANIAN WRIT APPEAL NO. 698 of 2017 Judgment: (per the Hon'ble the Chief Justice Sri Thottathil B. Radhakrishnan) This appeal, by a statutory authority is confined to imposition of costs on that authority.

Heard the learned Government Pleader for Revenue on behalf of the appellant and the learned counsel for the respondent-writ petitioners.

The learned Single Judge has interfered with the action of that statutory authority, but had ultimately left the private parties to seek remedies elsewhere on the facts and circumstances of the case. 4.

We do not find that there was any premise to impose costs on the statutory authority which was exercising jurisdiction in terms of the relevant statutory provision.

We therefore, allow this Writ Appeal and vacate the order of imposition of costs imposed in the impugned order. Pending miscellaneous petitions, if any, shall also stand closed. No order as to costs.
