THE HONOURABLE SRI JUSTICE B. VIJAYSEN REDDY CRIMINAL PETITION No.5552 of 2024 ORDER:

This Criminal Petition is filed under Section 438 of the Code of Criminal Procedure, 1973, seeking grant of anticipatory bail to the petitioner, who is Accused No.5 in Crime No.127 of 2024 on the file of the P.S. Kodad Town, Suryapet District, registered for the offences under Sections 376(2)(n), 417, 420, 504 and 506 of Indian Penal Code, 1860 ('IPC' for brevity).

Heard learned counsel for the petitioner and learned Assistant Public Prosecutor for the respondent-State. 3.

Petitioner is Accused No.5 in Crime No.127 of 2024 on the file of Kodad Town Police Station.

Learned counsel for the petitioner submitted that Crl.P.No.4239 of 2024 was filed by Accused Nos.1 to 3 seeking anticipatory bail in the event of their arrest in Crime No.127 of 2024 and the same was allowed by this Court vide order dated 26.04.2024.

The said contention is not disputed by learned Assistant Public Prosecutor.

In view of the above, the Criminal Petition is allowed and the petitioner/Accused No.5 shall be enlarged on anticipatory bail subject to the following conditions:

(i) The petitioner/accused No.5 is directed to surrender before the S.H.O., Kodad Police Station, Suryapet District, within a period of (15) days from the date of this order. On such surrender, the concerned S.H.O shall enlarge the petitioner-Accused No.5 on bail on his executing a personal bond for a sum of Rs.50,000/- (Rupees Fifty Thousand only) with two sureties for a like sum each to the satisfaction of the said S.H.O. (ii) The petitioner/Accused No.5 shall appear before the concerned S.H.O on every Tuesday at 11.00 A.M. for a period of eight (8) weeks or till the completion of the investigation, whichever is earlier.

(iii) The petitioner/Accused No.5 shall abide by the conditions stipulated in Section 438(2) of Cr.P.C and shall cooperate with the investigating officer in the investigation.

Miscellaneous applications, pending if any, shall stand closed.
