THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.27686 of 2015 ORDER:

Heard the learned counsel for petitioner and the learned Government Pleader for Civil Supplies for respondents.

2. The petitioner was appointed as a fair price shop dealer of shop No.230 of Moghulrajpuram, Vijayawada. While so, on the basis of the report dated 12.01.2015 submitted by the Assistant Supply Officer, Circle-II, Vijayawada, the second respondent issued a show cause notice and suspended the authorization of the petitioner, by his proceedings dated 28.01.2015. Thereafter, for the last seven months, the enquiry was not completed and final orders have not been passed by the second respondent. Challenging the inaction of the second respondent, the present writ petition is filed.

The second respondent should have completed the enquiry in respect of the allegations leveled against the petitioner within three months from the date of order of suspension, but he has not completed the enquiry even after lapse of more than seven months.

In the circumstances, the writ petition is disposed of directing the second respondent to conduct an enquiry in respect of the allegations leveled against the petitioner and complete the same, within a period of 30 days from the date of receipt of a copy of this order, by giving due opportunity to the petitioner.
