HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No. 26995 OF 2017 ORDER :

This writ petition is filed seeking writ of mandamus declaring the action of the respondents in not sending the petitioner for training though he was provisionally selected on a frivolous ground that at the time of submitting the application, the petitioner has furnished a wrong information regarding possessing HMV license though no document claiming such license was enclosed.

It is the case of the petitioner that pursuant to Notification in Rc.No.1511/Rectt./Admn.1/2015, dated 31.12.2015, he submitted application through online vide Registration No.118876 by duly filling all the relevant fields mentioned therein. That in the column pertaining to 'Type of License' inadvertently he mentioned the Transport Vehicle License (HTV/LMV), since he was not aware as to in which category his licence falls. That he was provisionally selected for the post of SCT PC (AR) under Driver Category by the 2nd respondent. While so, the 2nd respondent issued show-cause notice Rc.No.44/Rectt./Genl.1/2017, dated 17.05.2017 calling upon the petitioner to explain as to why his selection should not be cancelled as he has mentioned that he has HMV licence, when he is having only LMV license. That the petitioner filed explanation dated 18.05.2017 and 30.05.2017

stating that there was a confusion while filling up of the application, as such, said mistake was occurred. It is also stated in the explanation that he has enclosed only LMV licence and that for the said license only he was awarded marks. It is also stated that he never claimed to have possessed HMV licence. He submits that without passing any orders in pursuant to show-cause notice dated 17.05.2017, the respondents are sending the other provisionally selected candidates for training, whereas the petitioner is being denied for the same. Aggrieved by the same, present writ petition is filed.

Heard learned counsel for the petitioner and learned Assistant Government Pleader for Services.

Since the petitioner has already submitted explanation dated 18.05.2017 and 30.05.2017 to the 2nd respondent, the 2nd respondent is directed to pass appropriate orders within a period of two weeks from the date of receipt of a copy of this order and take action accordingly.

With the above direction, this writ petition is disposed of. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
