THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.5005 OF 2016 ORDER:

This petition is filed by the petitioners-accused Nos.1 to 7 under Section 482 Cr.P.C. seeking a direction to the V Additional Judicial First Class Magistrate, Nellore to advance the date of hearing of C.C.No.552 of 2015 and to dispose of the same within a period of three months.

Heard and perused the material available on record. The petitioners are alleged to have committed the offence punishable under Sections 498-A r/w 34 IPC and Sections 3 and 4 of the Dowry Prohibition Act. It is stated that the petitioners have filed a discharge petition and the same has not yet been disposed of. Considering the facts and circumstances of the case and in view of the prayer sought in this petition, this Court is inclined to pass the following order:

"The learned V Additional Judicial First Class Magistrate, Nellore, is directed to dispose of the discharge application filed by the petitioners as early as possible, if it is pending. If the petitioners are not discharged for the above said offences, the learned Magistrate is directed to conclude the trial, within a period of three months from the date of disposal of the discharge application."

Accordingly, the Criminal Petition is disposed of.

Consequently, the miscellaneous petitions pending in this petition, if any, shall stand closed.
