ORDER
This Criminal Petition is filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') for grant of pre-arrest bail to the petitioner, who is the sole
accused in Crime No.446 of 2026 of P.S. Narsingi, Rangareddy District, on the file of learned X Additional District & Sessions Judge, Ranga Reddy District at Rajendranagar, registered for the offences punishable under Section 69 of BNS. 2.
The case of the prosecution is that the de facto complainant lodged a complaint before the Police on 09.03.2026 stating that she came to Hyderabad on 27.11.2025 for a private job. About four months prior to the complaint, she got acquainted with the petitioner and subsequently, they developed a relationship. It is alleged that the petitioner, on the pretext of marrying her, had physical relations with the de facto complainant in the months of December, 2025 and January, 2026. It is further alleged that the petitioner obtained an amount of Rs.55,000/- from the de facto complainant stating that he was in need of money. Subsequently, when the de facto complainant insisted upon marriage, the petitioner refused to marry her. Based on the said complaint, Crime No.446 of 2026 was registered for the above said offence.

Heard Sri Ravi Kumar Reddy, learned counsel for the petitioner as well as Sri M. Ramachander Reddy, learned Additional Public Prosecutor appearing on behalf of the respondent - State.

Learned counsel for the petitioner submitted that the petitioner is aged 25 years and working as a delivery boy. The petitioner is innocent and he is falsely implicated in the above case by the prosecution and is no way concerned with the alleged offence. However, the relationship between the petitioner and de facto complainant is consensual in nature. As an F.I.R. is registered against the petitioner, the petitioner is ready to co-operate with the investigation and prays this Court to grant pre-arrest bail to the petitioner by allowing this Criminal Petition.

On the other hand, learned Additional Public Prosecutor opposed the petition, submitting that the allegations against the petitioner are serious and heinous in nature. Having regard to the nature and gravity of allegations, the petitioner is not entitled for grant of anticipatory bail at this stage and prays this Court to dismiss the Criminal Petition.

Having regard to the submissions made by the learned counsel on either side and upon perusal of the material available on record, and considering that the petitioner is stated to be aged about 25 years and working as a delivery boy and there is no material placed before this Court to show that he is a habitual offender or has criminal antecedents, and a prima facie examination of the record indicates that the relationship between the petitioner and de facto complainant appears to be consensual in nature and considering the nature of offence alleged against the petitioner, this Court deems it fit to grant pre-arrest bail to the petitioner, subject to the following conditions:
i.
The petitioner shall surrender before the Station House Officer, P.S.
Narsingi, Cyberabad Commissionerate within two weeks from today, and on such surrender, the said Station House Officer shall release him on bail on executing a personal bond for Rs.25,000/-, each with two sureties, for the like sum each.
ii.
The petitioner shall abide by the other conditions stipulated in Section 482(2) of Bharatiya Nagarik Suraksha
Sanhita, 2023 and co-operate with the Investigating Officer in investigating the case.
iii.
The petitioner shall appear before the concerned Investigating Officer on every Wednesday between 09:00 a.m, and 05:00 p.m., for a period of eight
(8) weeks or till the filing of the charge sheet, whichever is earlier and thereafter, as and when required.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
