THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION Nos.37367, 37985, 38769 and 39129 of 2015 COMMON ORDER:

These writ petitions were filed assailing the alleged inaction on the part of the authorities in taking steps to investigate the offences alleged against Kapil Chit Funds Private Limited and its sister concerns.

Sri M. Janardhana Rao, learned counsel for the petitioners in these cases, states that the investigation into the alleged offences has now commenced and that the CID is seized of this exercise. In that view of the matter, as the police authorities concerned have to take steps in accordance with law in the process of investigation and taking action thereafter, this Court sees no purpose served in keeping these cases pending. Though the learned counsel for the unofficial respondent companies seeks time to file counteraffidavits in these cases, this Court is not inclined to enter into the merits of the matter as the investigating agency would first have to look into the allegations made against the companies in the context of the offences alleged against them and take appropriate action in the matter in accordance with law.

The writ petitions are therefore closed directing the investigating agency concerned to take steps in the matter and complete the investigation expeditiously in accordance with law. Pending miscellaneous petitions, if any, shall also stand closed. No order as to costs.
