According to the petitioner, she was a Mini Anganwadi worker at Jinkalamitta, Pakala Mandal, Chittoor district and she resigned the said post, filed nomination for the post of MPTC at Damal Cheruvu-II, Pakala Mandal on 20.3.2014, but lost the election. Therefore, she made a representation dated 20.5.2014 to the respondents 2 and 3 for re-appointing her as Mini Anganwadi worker. It is alleged that no orders were passed on her representation and on the contrary, the said respondents issued a notification calling for applications for filling up the vacant post of Mini Anganwadi worker afresh and it was published in newspapers on 20.3.2015 and 21.3.2015. Challenging

the said notification, the present writ petition is filed. I have heard the learned counsel for the petitioner as well as learned Government Pleader for Women Development and Child Welfare appearing for the respondents. However, I do not see any legal right in the petitioner to ask for a direction to the respondents to consider her representation, referred to above and inasmuch as the post of Anganwadi worker is now admittedly vacant as the petitioner had resigned earlier. In view of that, any appointment to the said vacant post has to be made only in accordance with law and in that process, the notification has now been issued and published in newspapers on 20.3.2015 and 21.3.2015. If the petitioner is interested for the post, she is at liberty to apply in terms of the said notification and if such an application is received, the same shall be considered by the respondents 2 and 3 along with other eligible candidates.
