HON'BLE SRI JUSTICE S.V. BHATT Writ Petition No.12495 of 2017 ORDER:
The petitioner has been making serious efforts for getting assignment of an extent of Ac.2.52 cents in Sy.No.524/ 1 of Potharlanka village, Kollur Mandal, Guntur District. The 4th respondent, through endorsement in Rc.No.83/ 2007-DT dated 06.03.2017, rejected the application of the petitioner for granting assignment. The endorsement dated 06.03.2017 is assailed in this writ petition.
2. The petitioner relies upon the communication of the 3rd respondent dated 29.08.2016 and contends that the assignment ought to have been granted. The learned Assistant Government Pleader for Assignment contends that the endorsement has to be treated as refusal by the primary authority and the petitioner can workout the remedies before the 3rd respondent for grant of assignment or suitable direction in this behalf.
3. After perusing the endorsement dated 06.03.2017 and letter dated 29.08.2016, this court is of the view that the petitioner ought to avail the remedy of appeal before the 3rd respondent. Hence, the writ petition is disposed of by this order.
(a) The petitioner is given liberty to file appeal by enclosing a copy of this order before the 3rd respondent within four weeks from today.
(b) The 3rd respondent, after filing of the appeal by the petitioner as directed by this court, is directed to consider and dispose of the same as expeditiously as possible, preferably within six (6) months from the date of presentation of appeal.
4. The writ petition is, accordingly, disposed of. No order as to costs. Pending miscellaneous petitions if any in this writ petition shall stand dismissed in consequence.
