THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO. 3496 of 2022 O R D E R:

This Criminal Petition is filed under Sections 437 and 439 of the Code of Criminal Procedure, 1973 (for short "Cr.P.C.") seeking to enlarge the petitioners, who are arrayed as accused Nos.3,4 and 5, on bail in connection with Crime No.26 of 2022 of Bollaram P.S registered for the offence punishable under Sections 20 (b) (ii) (C) , 27 read with Section 8 (c) of NDPS Act, 1985 2.

Heard the learned counsel for the petitioners and learned Assistant Public Prosecutor for the respondent-State and perused the record.

During the course of investigation these petitioners were identified as drug consumers and remanded to police custody on 29.03.2022. Even according to the remand report there are no other allegations except stating that the petitioner were regular consumers of drugs and accordingly remanded to judicial custody.

The learned Counsel for the petitioners submits that according to the prosecution the petitioners were only drug consumers and protection is also prescribed under NDPS Act. However, keeping in view that the allegation against these petitioners is only of drug consumers, the petitioners can be released on bail.

In the said circumstances, the petitioners 1 to 3 /Accused 3,4 and 5 are directed to be released on bail on their executing personal bonds for Rs.20,000/- (Rupees Twenty Thousand only) each, with two sureties each for like sum to the satisfaction of the learned XXII Addl. Chief Metropolitan Magistrate, Hyderabad. The petitioners shall appear before the police concerned, on every Saturday, for a period of two months.

Accordingly, the Criminal Petition is allowed. As a sequel thereto, miscellaneous applications, if any pending, shall stand closed.
