The learned counsel for the appellants called absent and there is no representation his behalf.
In fact, as per the docket proceedings dated 15.07.2022, the matter was listed with a condition that in default of any representation for the appellants, the appeal stands dismissed. However, for a fair play, it was again listed today. But, today also there is no representation on behalf of the appellants. Therefore, having regard to the docket proceedings dated 07.07.2022 and 15.07.2022, the appellants are not evincing any interest in prosecuting the matter and the appeal suit is pending for the last 19 years, I find no merit to adjourn the matter in the absence of proper representation. Accordingly, the appeal is dismissed for non-prosecution. However, in the circumstances of the case, there shall be no order as to costs.
As a sequel, miscellaneous applications, if any pending in this appeal, shall stand closed.
