This writ petition is filed assailing the action of the 3rd respondent in removing him from the services of the post of Field Assistant, by proceedings dated 08‐06‐2017. The grounds on which the impugned order was passed is on account of the petitioner allegedly involving in misappropriation public funds. By the impugned order, the petitioner was also directed to pay certain amounts alleged to have been misappropriated.

Though the learned counsel for the petitioner seeks to assail the order on various grounds, learned Standing Counsel for 3rd respondent submitted that the petitioner has already filed appeal against the impugned order dated 08‐06‐2017 and, therefore, he cannot be allowed to continue parallel proceedings.

Inasmuch as the petitioner has already availed the remedy of filing statutory appeal against the impugned order, the 2nd respondent‐appellate authority is directed to dispose of the appeal said to have been filed by the petitioner, after issuing notice and affording opportunity of being heard to him in the matter and pass appropriate orders thereon, in accordance with law, within a period of six weeks from the date of receipt of a copy of this order. Till disposal of the appeal, there shall be stay of recovery of amounts in question from the petitioner.
