HON'BLE SRI JUSTICE A. SHANKAR NARAYANA WRIT PETITION No.14064 OF 2004 ORDER:

The instant Writ Petition is filed seeking Mandamus to declare the order, dated 03-04-2004, in Memo No.33499/Asst.II/2003-8, passed by respondent No.2 in so far as it relates to giving liberty to respondent Nos.3 to 7 to file appeal before respondent No.1, and the action of respondent No.1 in entertaining the appeal filed by respondent Nos.3 to 7 against the order, dated 14-02-1997, in RC.No.E/40/1989 passed by the Mandal Revenue Officer, Chennaraopet, Warangal District as illegal and without jurisdiction and, consequently, to set aside the proceedings initiated by respondent No.1.

2. During the course of hearing, learned counsel for the petitioners represents that the appeal was already entertained and orders were also passed by respondent No.1 on 30-07-2005 dismissing the appeal filed by respondent Nos.3 to 7 and to close the instant writ petition.

3. The learned Government Pleader for Revenue has placed a copy of the order passed by respondent No.1 for perusal dismissing the appeal preferred by respondent Nos.3 to 7.

4. Recording the aforesaid submission and as the appeal was already disposed of by respondent No.1 on 30-07-2005 dismissing the appeal filed by respondent Nos.3 to 7, the instant Writ Petition is closed. No order as to costs. 5 . As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, stand disposed of.
