This Criminal Petition is filed under Section 482 of the Code of Criminal Procedure seeking quashing of the proceedings in C.C.No.125 of 2019 on the file of the Judicial First Class Magistrate at Shadnagar'
A charge sheet carne to be filed against the petitioner/ accused for the offence punishable under Section 138 read with Section l4l of the Negotiable Instruments Act, 1881.
Though the present Criminal Petition is filed seeking quashing of entire proceedings, but learned counsel for the petitioner/ accused restricts his prayer seeking dispensation of the presence of the petitioner/ accused before the trial Court on every date of adjournment.
The learned Public Prosecutor submits that since the identity of petitioner/ accused is not in dispute, her presence in the above case may not be necessary on every date of adjournment.
Having regard to the facts and circumstances of the case, the personal appearance of the petitioner/ accused in C.C.No.125 of 2Ol9 on the file of the Judicial First Class Magistrate at Shadnagar, is hereby dispensed u'ith except on
the dates when her presence is specifically required by the Court.
