THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.31915 of 2015 ORDER:

The prayer of the petitioner is in the following terms: "The Hon'ble Court may be pleased to issue a writ, order or direction more particularly one in the nature of writ of Mandamus for inaction of the 1st respondent State Police to conduct a fair and transparent enquiry/ investigation against the petitioner's missing husband namely Kandala Jagannadham right after the contract from the custody of the 6th respondent, despite the petitioner's complaint to the 4th respondent police made on 10.08.2015 is quite arbitrary, illegal, ultravirus and contrary to the basic human rights as contemplated under the Constitution of India and also allied statutes and consequently seeking kind indulgence of this Hon'ble Court to direct the 7th respondent CBI to conduct a fair enquiry/ investigation against the petitioner's missing husband namely Kandala Jagannadham and place the Preliminary Enquiry report before this Hon'ble Court for proceeding further in the matter and pass such other order or orders as seem fit and proper in the circumstances of the case."

Relying on the written instructions dated 23.11.2015 furnished by the Station House Officer, Nekkapalli Police Station, Yelamanchili Circle, Visakhapatnam District, the learned Assistant Government Pleader for Home informed this Court that the husband of the petitioner was traced out at Puri in Odisha State. He was stated to have been suffering from a mental condition and was handed over to the petitioner in the presence of the Sarpanch, Ex-Sarpanch and other villagers of Nakkapalli.

The afore-stated aspects of the matter are not denied by Sri V. Surendra Reddy, learned counsel for the petitioner. However, he would state that there are other grievances relating to this issue which require to be redressed. In view of the said statement, this writ petition is closed leaving it open to the petitioner to take recourse to appropriate remedies in accordance with law in relation to any other grievance, if so advised.

Pending miscellaneous petitions, if any, shall also stand closed. No order as to costs.
