THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.20658 OF 2017 O R D E R:

This Writ Petition, under Article 226 of the Constitution of India, came to be filed seeking issuance of Writ of Mandamus declaring the action of the respondents in not granting permission, affiliation and admission to the petitioner's college to run B.Sc., B.Ed., Integrated programme of Four years duration with an annual intake of 100 students from the academic session 2017-18 pursuant to the recognition granted by the NCTE dated 02.05.2016 as illegal and arbitrary.

Heard the learned counsel for the petitioner, learned Government Pleader for Education for respondents 1 and 2, Sri V. Kishore, learned Standing counsel for respondent No.3 and Sri P. Madhusudhan Reddy, learned standing counsel for the 4th respondent. With their consent, the Writ Petition is disposed of at the stage of admission itself.

Though various grounds are raised in the Writ Petition, the learned counsel for the petitioner restricts his prayer seeking a direction to the 4th respondent to consider the representation dated 23.05.2016 made by the petitioner-College seeking affiliation, at the earliest. Learned Standing Counsel appearing for the 4th respondent submits that the 4th respondent may be directed to dispose of the representation dated 23.05.2016 submitted by the petitioner, if the same is still pending consideration.

Having regard to the above, without going into the merits of the case, the Writ Petition is disposed of directing the 4th respondent to deal with the representation submitted by the petitioner seeking affiliation to the Course referred to above, if such representation is still pending consideration, in accordance with law, as early as possible, preferably within a period of ten days from today.
