O R D E R

Aggrieved by the action of 3rd respondent - Regional Passport Officer, Secunderabad, Telangana State, in refusing to issue passport to the petitioner vide her application in File No.HY2062207598119 dated 17.06.2019, the present writ petition is filed. Heard the learned counsel for the petitioner. Learned Standing Counsel for Central Government, appearing for respondents 1, 3 and 4, on instructions, submit that in police verification, it was found that a criminal case in S.C.No.79 of 2017, on the file of VII Additional District and Sessions Judge Cum Spl. Judge for Trial of SC & ST (POA) Act, Rangareddy District, is pending adjudication and hence the passport was refused. He states that as per Gazettee Notification GSR 570E, dated 25.08.

1993, the request of the petitioner for issuance of the passport to travel abroad can be considered only if she gets permission from the court where the criminal case is pending. The fact that the above stated criminal case is pending against the petitioner, is not in dispute. Hence, in view Gazettee Notification GSR 570E, dated 25.08.1993, liberty is given to the petitioner to make necessary application before the criminal court, where the above referred case is pending, and the said court to consider the same and pass appropriate orders in accordance with law, as expeditiously as possible, preferably within two weeks from the date of making such application, and based on such orders, petitioner may file fresh application seeking passport, which shall be considered in accordance with law.
