Heard the leaned counsel for petitioners and learned Government Pleader for Revenue appearing for respondents. 2.

In spite of the fact that a Writ Petition No.20925 of 2008 was allowed on 18-03-2009 quashing the proceedings in respect of the subject land under the provisions of the Urban Land Ceiling and Regulation Act, 1976, which order had attained finality, the respondents in the Contempt Case had included the subject land under the list of prohibited properties issued under Section 22-A of the Registration Act, 1908 (for short 'the Act').

When this was questioned in W.P.No.39035 of 2017, this Court allowed the said Writ Petition on 27-11-2017 by giving a finding that such act of respondents amounts to contempt of orders passed by this Court in W.P.No.20925 of 2008 since the subject land cannot be termed as Government property at all and could not have included in the prohibitory list under Section 22-A of the Act. 4.

The Registry of this Court was directed to issue show cause notice to 3rd respondent in the Writ Petition, who is the 2nd respondent herein, to show cause why proceedings for Contempt of Court shall not be initiated against him for including the subject land in the prohibitory list under Section 22-A of the Act.

It is merely stated in the counter that after receiving the order dt.27-11-2017 in W.P.No.39035 of 2017, steps were taken to delete the subject land from the prohibitory list. No explanation is forthcoming why it was included in the prohibitory list in the first place. 6.

However, an unconditional apology has been given by the 2nd respondent, which is accepted, and since steps have been taken to delete the subject land from the prohibitory list under Section 22-A of the Act on 07-04-2018, this Contempt Case is closed. However, the 2nd respondent shall personally pay costs of Rs.5,000/- (Rupees Five Thousand only) to the petitioners within four (04) weeks.
